A Formal Complaint must be filed by the Complainant or signed by the Title IX Coordinator in order to initiate the informal or formal procedures described in Procedure 1 or Procedure 2. The determination about which grievance procedure applies depends on the status of the parties and the type of Prohibited Conduct alleged.
Procedure 1
Procedure 1 applies to Formal Complaints of Prohibited Conduct made pursuant to the Title IX & Sexual Misconduct Policy when the following conditions are met:
- The University has has jurisdiction over the allegations in the Formal Complaint pursuant to Section B of the Policy; and
- The Formal Complaint includes at least one allegation of Sexual Assault/Rape, Sexual Assault/Fondling, Dating/Domestic Violence, Sexual Exploitation, Title IX Sexual Harassment, Non-Title IX Sexual Harassment, Harassing Communications, or Stalking.
Procedure 2
Procedure 2 applies to Formal Complaints of Prohibited Conduct made pursuant to the Title IX & Sexual Misconduct Policy when the following conditions are met:
- The Formal Complaint does not meet the conditions outlined in Procedure 1, Section A;
- The University has jurisdiction pursuant to Section B of the Policy;
- The Formal Complaint includes at least one allegation of Sex-Based Discrimination, Retaliation or Failure to Comply.
The process for resolution of Formal Complaints under each Procedure is designated based on the status of the Respondent: student or employee.
